Tyron McAlpin files $3.5M notice of claim against Phoenix
Tyron McAlpin, the Black Deaf man with cerebral palsy who was punched and tasered by Phoenix police officers in August, filed a $3.5 million notice of claim against the city on November 19.
A notice of claim is a legal process that is required in Phoenix and other cities — it has to be filed prior to a lawsuit.
ABC 15 Arizona explained that officers initially went after McAlpin based on false and unverified allegations from another man. Videos showed that two officers immediately tackled him and tasered him without any good attempt to communicate. The officers didn’t realize McAlpin was deaf until after the arrest. He was jailed for 24 days and charged with felony assault and resisting arrest, but the charges were dropped.
The two officers are now on administrative leave and the police department said it’s conducting an internal investigation.
The notice of claim said McAlpin is willing to resolve his claims with Phoenix if the $3.5 million amount is paid. The city has 60 days to respond — by mid-January.
