It is Friday, November 12. Here are today’s top stories.

The FDA announced a recall of 2.2 million of Covid-19 tests made by Ellume due to higher-than-acceptable false positive test results. The FDA is basically saying the tests are unreliable. A false positive could cause someone to seek treatment when they didn’t need to or to overlook another health condition. If you have recently purchased an Ellume test, you can check your product by finding the lot number on the sticker on the side of the box and inputting the number in the Ellume website. The FDA said negative test results were not affected by the issue. Ellume said they have identified the root cause of the problem and have corrected it and are already shipping new products.

The defense attorney for one of the three white men in Georgia who is on a murder trial for the death of Black man Ahmaud Arbery in February 2020 sparked controversy yesterday by telling the court, “We don’t want any more Black pastors coming in here.”

The defense attorney, Kevin Gough, was objecting to the fact that Rev. Al Sharpton, a prominent civil rights activist, was in the courtroom to sit with Arbery’s family. The attorney said there should be a limit on the amount of Black pastors in the courtroom because he felt like they could intimidate the jury. 11 out of 12 of the jurors are white.

Sharpton told TMZ that the defense attorney showed “arrogant insensitivity” and a “disregard for the value of the human life lost and the grieving of a family in need of spiritual and community support.” He said he would return to the courtroom in the future.

Today the defense attorney apologized to anyone who may have been offended. The murder trial is still going on.

On Thursday evening, there was a large group of protesters opposed to vaccine mandates who congregated near the entrance of the Golden Gate Bridge in San Francisco. Police officers were there to try and prevent them from blocking the bridge. Then there was a car crash that injured two police officers and three other people and caused heavy traffic backups.

The LAPD Police Chief Michael Moore told CBS News that he is ready to fire any of LAPD’s 12,000 employees if they refuse to get the Covid-19 vaccine or undergo twice-a-week testing. The deadline is December 18. On November 4, the LAPD said it delivered notices to 3,500 unvaccinated employees to inform them of their requirements.

The LAPD chief’s remarks supporting the vaccine mandate contrasts with the Los Angeles County Sheriff’s Department Alex Villanueva, who criticized the vaccine mandate and expressed concerns that over 4,000 employees might have to be terminated. Villanueva said he won’t comply with the vaccine mandate.

The defense in the murder trial of Kyle Rittenhouse, who is charged with fatally shooting two men and injuring a third man, rested its case on Thursday. AP News said it sets the stage for closing arguments on Monday and that a key question is whether Rittenhouse was a “patriot taking a stand against lawlessness or a vigilante.”

There was a new controversy with the judge in the case, Bruce Schroeder, because he made a joke that was viewed as anti-Asian in nature. The judge, before he adjourned the court for a lunch break, quipped, “I hope the Asian food isn’t coming, (that it isn’t) on one of those boats from Long Beach Harbor.” The judge seemed to be referring to the supply chain backlog at California harbors. Several Asian American leaders said the judge’s comments were not okay because it unfairly puts blame on Asian people for issues with our supply chain and that the joke shows that the judge lacks cultural sensitivity.
