Voting Lawsuits

Hello!  There are many election-related litigation going on as they make their way through every level of the court system.

According to ABC News, the 2020 election is already regarded as the most litigated in American history, due in large part to the massive expansion of mail and absentee voting.  The last time I checked, there were at least 228 lawsuits in 45 states, DC, and Puerto Rico.  I will expect the numbers to increase.

The Republican Party is involved in more than 40 lawsuits, and the Democratic Party is involved in lawsuits that are happening in 15 states.

Out of many hundreds of election-related cases, I will pick four of the most-watched cases. 

Democratic National Committee v. Bostelmann (currently being reviewed by the U.S. Supreme Court)  

The lawsuit looks at whether Covid-19 requires Wisconsin to change election rules, such as extending the deadline to return absentee ballots, permitting electronic delivery of voters’ ballots, and hiring out-of-county poll workers.

Michigan Alliance for Retired Americans v. Benson (currently being reviewed by Michigan Court of Appeals)  

The lawsuit looks at whether the secretary of state of Michigan can extend the deadline to receive absentee ballots and whether this violates federal law.

Donald J. Trump for President, Inc. v. Bookvar (currently being reviewed by U.S. District Court for the Western District of Pennsylvania)

The lawsuit looks at whether Covid-19 requires Pennsylvania to change election rules, such as providing more drop-off sites for ballots, not enforcing signature-matching requirements for absentee ballots, and hiring out-of-county poll workers violate federal law.

Raysor v. Desantis (currently being reviewed by U.S. Court of Appeals for the 11th Circuit)  

The lawsuit looks at whether the requirement for felons in Florida are to pay all prior court fines before voting violates federal law.

The lawsuits are all the more important because they concern the fundamentals of the American voting process during an election shaped by Covid-19 and President Trump’s distrust in mail-in ballots.
