Mavrick jailhouse video raises questions

Alex:

Last night a deaf vlogger named Kirk Winkler posted a video sent in to him from someone else who had a videophone conversation with Mavrick Fisher, who is in jail.

The video shows Mavrick reacting to the other person who said he found a rock that had a certain size with a pointy end. Mavrick seemed to be shocked that the rock was found and said he was glad that police/evidence teams were not able to locate it because it was too big for him to handle with just one hand.

Mavrick Fisher:

It was pointy at one end, yes? You found it? It was big. Big. Big. About this size? You found? Fuck. Oh I’m glad you found it. I’m happy you found it. Take it away! Don’t let the police find it.

Let me tell you, if… If… If, if… The evidence (team) found that rock, I’m fucked. I’m fucked. Fucked.

Because, because with just one hand… Do it look like I could do it with one hand? Does it look like I could? No. Not one hand. Ooohh!!!

Alex:

It’s important to note here that during the trial, on Day 8, Mavrick said the rock he used to strike Grant was about the size of a brick and he could carry it with one hand.

CALLIE FRYE:

The rock should look like a brick.

DA: How heavy was it?

Mavrick: It feels like a brick.

DA: Did you need two hands to hold the rock and carry it? Or just one hand?

Mavrick: Just one hand.

Alex:

So, there are questions raised on whether Mavrick was truthful during his testimony.

The person who was on the other end of the call is a deaf man named Blake Tucker, Jr., who is from Alabama.

He met with Mavrick in person at the Lake County Jail the week before Mavrick Fisher’s arraignment hearing on September 9, 2019. I did meet him at that time and did an interview with him, but I never aired it. I’ll show you a clip from 2019.

Blake Tucker:

Two days ago I got there. I saw the campsite and it was “off season.” It was closed and you couldn’t get in. I told the park ranger I wanted to investigate the site. They told me I could, but I had to walk there, not drive. So I walked and I found the campsite, Lot #80. It matched with what Mavrick told me. I checked out other campsites from a police report and there were no rivers there. But this one had a river, and Mavrick told me he threw a rock in the river. This was the only campsite with a river, so it was obvious. As I looked around, I remember Mavrick telling me that he couldn’t remember anything, that he was scared. He said all he could remember was that his phone’s light shone on an orange life jacket near the river. I spotted an orange life jacket. I didn’t see anything about a murder weapon, so I went ahead and did the work by myself. Just out of the blue I decided to check. I looked for a good hour through many different rocks. I looked at the clear, “shiny” rocks, not at the rocks covered with moss. I found some rocks that were too big. I couldn’t imagine Mavrick at his size brandishing that size of a rock. I found a few rocks and left them to dry. I could see that one of the rocks, when it became dry, that it had a reddish or brownish blood stain. I thought it must be the one. I felt sick. I pondered what I should do. Reach out to the police? That’s when I reached out to you, and you told me that I should contact the park ranger. So I gave it to them and they said they saw blood, but doubted that it was a murder weapon. The ranger said people who went camping would often use rocks to kill fish before cooking them. That made sense to me. But the ranger said “Thank you” and that they would send it over. But what was strange is that the campsite is within Humboldt County.

Alex:

The rock Tucker described never turned up during the trial, and Tucker was never called as a witness.

Alex:

After the jailhouse video went viral, I reached out to Tucker and asked if he was the one who called Mavrick. He confirmed it. He said he ended up leaving the rock behind a Days Inn by a dumpster.

Tucker said a few weeks ago he decided to make a drawing of Mavrick and mail it to him at the jail with his number, and Mavrick called him. Tucker told him about the rock. Tucker will describe what he said before Mavrick reacted.

Blake Tucker:

I said I even went to the RSG and found the rock. Mavrick was shocked and didn’t believe I found the rock. I said yes, you described the rock to me, that was about this size with a pointy end. Mavrick said, “Yes, the one with the pointy end,” and was shocked. He was shocked I found it and that police didn’t want it. He said if police had it, then maybe he would be fucked or not. He was shocked about the rock. Then I made some jokes, humor jokes, and he laughed. That part is what you saw with the clip. He was not laughing about the rock, but it happened to be in that moment. He was overwhelmed and shocked. He was wondering about the fact I found it. I told him that I did things exactly from his description and he said yes, the rock matched it. So that’s all.

Alex:

I asked Tucker if Mavrick knew he was being recorded and Tucker said he didn’t know that. Tucker said he decided to share it with Kirk as a part of their ongoing conversations about the case. Tucker said he did not show Mavrick the pictures of the rocks in the VP conversation, but only discussed the appearance of the rocks.

So, that’s the story behind the video. Will it change anything in the Mavrick case?

I reached out to Mavrick’s defense attorney, Thomas Feimer. He said he had no comment.

I reached out to the District Attorney Susan Krones. She said she is investigating it and following up with the report. Krones said her office never received the rock from the individual and was never aware about it, but would follow up to see if anyone got it.

Krones said Mavrick already went through a trial and was found guilty of involuntary manslaughter and had other deadlocked charges dismissed. She said it is difficult to start a new trial because of double jeopardy concerns.

To go back a bit, turing the trial, Detective Brandon Head from Humboldt County testified that he collected 20 rocks that seemed suspicious with blood on it. Two of the rocks were brought to the lab, and one rock was found to have Mavrick’s blood on it. However as far as I remember there was no indication that either side claimed that a specific rock was the deadly weapon.
