Attorney seeks immediate release of Deaf Jan. 6 riot defendant Vitali GossJankowski

On Monday, President Trump granted clemency to all of the 1,500 people charged with crimes in connection to the Jan. 6 2021 riot at the Capitol.

This means Deaf defendant and former Gallaudet University student Vitali GossJankowski, who was found guilty in March 2023 of felony and misdemeanor charges related to the Jan. 6 riot, is going to get clemency.

A D.C. area reporter named Jordan Fischer posted on X that a new federal official in D.C. filed many motions to dismiss Jan. 6 cases last night, including the GossJankowski case.

GossJankowski was convicted but never received his sentence – but has been in a D.C. jail since October 2023.

To go back a bit, after GossJankowski was found guilty, a judge allowed him to remain free while he awaited his sentencing. But that changed when prosecutors said GossJankowski sent intimidating, hateful, and harassing messages to a law enforcement officer who testified in his case and made social media posts about them.

Prosecutors raised concerns and a judge ordered him to be jailed. Fischer, who was in the courtroom at that time in October 2023, reported that GossJankowski resisted against a marshal who tried to take him into custody, which led to a scuffle that involved multiple officers and ended with him going to jail.

Now, fast forward to today. After Trump’s actions of clemency, Fischer reported that GossJankowski’s defense attorney asked the D.C. District Court on Monday to immediately release him from detention and said a court order is needed because he hasn’t been sentenced or put into the custody of the Bureau of Prisons. So he’s in a gray area and needs this court order.

I don’t know how quickly the D.C. court will respond to this motion and whether GossJankowski has been released yet. I’ve reached out to his defense attorney for an update.

WUSA9 News in D.C. said there are dozens of people/protesters standing outside of the D.C. Central Detention Facility waiting for the release of Capitol rioters. Some people posted on X this afternoon that GossJankowski, along with others, haven’t been released.
